Abstract

Based on the research of unpublished documentary and published normative sources, the author analyzes the correlation between the traditional «ordinary» and introduced «legal» orders of inheritance of noble family property on land. The author pays special attention to the functional purpose of restitution of estates alienated from the possession of the noble family. In conclusion, the author concludes that the patrimonial mode of representation of the nobility presupposed the mandatory identification of all members of the clan by conferring on the nobleman a generic name, conferring on him the patrimonial property or the right to inherit and repurchase it. At the same time, an original description of the tribal affiliation of a noble woman ensured the possibility of continuous reproduction of the aristocratic tribal organization as a structural whole.
