Abstract

Article is devoted to activities of the Soviet judicial system for consolida-tion of institute of marriage in the mid-forties – the beginning of the 1950th on the example of Leningrad. At this time especially strong was an influence of the state on questions of a family and marriage, and the court became the convenient tool in hands of the power. On the basis of the attracted archival materials the author analyzes participation of judicial authorities in permission of the civil and criminal cases affecting marriage bases. In article the emphasis on an educational component of this work is placed. The author comes to a conclusion that the Soviet judge turned out in such legal and ideological and world outlook conditions that not only could not execute the function of "protection of a family" without thinking about party and higher departmental bodies, but also itself it appeared on position of the oppressed right of liberty of conscience
