Abstract

The article explores the historical, political and social conditions in which there was the introduction of the Institute of probation in the criminal jus-tice system of the Russian Empire of the early twentieth century. Great at-tention is paid to lawmaking activity of national institutions such as the Ministry of justice, the State Duma, the Council of State. Researching several works of Russian lawyers, investigating how the question of the content of the law Institute. The article analyses the debate in the scientific community that arose between theorists of criminal law on the introduction of probation. The provisions of liberal and conservative politicians in the State Council, speaking in support of the introduction of the new penal institution and against the proposed changes. Researching the causes of both the development and the introduction of the Institute of probation and not implement it in Russian criminal law of the beginning of XX century.
