In the article carried out an attempt to assess the Soviet legislation on religion (1929-1990) through the alembic of historical analysis, carried out in the study of domestic and foreign researchers historians. It is concluded that the contradictory of this legislation and, at the same time, historical conditionality of this contradiction, with concrete examples
