Subject extraordinary cassation checks as reflection properties of res judicata

The article analyzes the impact of the adoption of the Federal Law № 433-FZ of December 29, 2010, according to which the Russian appeal proceedings significantly reformed along the lines of the national supervisory review. The conclusion about the importance of justice of judges who understand both the value of the limited subject of an extraordinary inspection, and the true purpose of exclusive control and verification of production in the context of the institutional idea of certain rights. For example, a specific judicial act renewed appeal of the Russian author analyzes the final decision of the court for compliance with the rule of res judicata and the essence of a new appeal.Published
