PRIVILEGES OF FOREIGNERS IN OLD RUSSIAN LAW

This article discusses the privileges of strangers (foreigners) provided to them in Old Russian Law. Based on the study the author concludes that Russkaya Pravda contains two examples of the privileges of strangers (foreigners). The first is priority in bankruptcy proceedings (privilegium exigendi) over all natives or over natives, with the exception of the prince. The second is simplification of proceedings: changing the evidence type (privilegium de non adducam testes) and reducing or increasing the number of witnesses in the process, depending on the strangerʼs (foreignerʼs) interest. The granting of privileges to strangers (foreigners) we explain by pragmatic goals (the predominance of foreign trade in the state economy), archaism of Old Russian Law and the converting to Christianity.
