Abstract

The article considers the problems associated with the lack of doctrinal definition of the concept of civil liability and the lack of identified common features of such liability in the works of Russian legal scholars.  On the basis of the conducted analysis as a protection of rights and legitimate interests of participants of civil legal relations. characteristic feature of civil-law liability is highlighted its protective function, manifested in different ways in different legal relations. In this regard, it is proposed to consider civil-law liability as a complex, comprehensive phenomenon that provides
