On the specifics of the content of the parental legal relationship when a child resides separately from one of the parents

Abstract

The author examines the parental legal relationship when a child resides separately from one of the parents, focusing on the content of the parental rights and responsibilities of each parent. The author especially emphasises the legal consequences of improper exercise of parental rights and responsibilities by each parent. The scientific novelty of the study is confirmed by a fundamentally new approach to the study: in contrast to the position of most scientists, the author for the first time identifies and substantiates the specifics of the content of the parental legal relationship under such social circumstances in the context of the legal consequences of the living separately from one of the parents. In addition, basing on modern law enforcement practice the author concludes that the separation of one of the parents from the child and the incomplete exercise of parental rights may become the basis for depriving this parent of certain rights based on the fact of kinship with the child.
