Abstract

The complex and lengthy process of personal socialization is influenced by numerous factors, which requires in-depth analysis in order to develop adequate measures to prevent, suppress and correct antisocial and illegal behavior of minors, which, in turn, must take into account their rights and legitimate interests. The emerging judicial practice shows that the current legislation does not fully ensure the solution of these tasks, does not fully reflect the needs of the time. Because of this, the courts have to make adjustments to the activities of the subjects of prevention, sometimes canceling their decisions, ensuring the protection of the rights of minors in the prevention of antisocial and illegal behavior. All this points to the need to find legislative solutions to improve the prevention of antisocial and illegal behavior of minors, which should include an audit of the legal terminology used, reflecting modern realities, rethinking the principles of organizing such work, systematizing it and filling it with qualitatively new content reflecting the main idea – the protection of the rights and legitimate interests of the child and the preservation of his family.
