Abstract

The aim of the work is to demonstrate some examples of the application of the category "good faith" in the marriage and family legislation of the Russian Empire. In the course of the study, it was established that in the marriage and family legislation, good faith was used both in the objective and subjective sense, which allows us to talk about the systematic use of this category in legislative activity. The author also comes to the conclusion that the introduction of the category "good faith" into the marriage and family legislation contributed to the improvement of mechanisms for protecting the rights and interests of married women from abuse of power by their husbands.
