Abstract

The research analyzes the criminal procedure legislation of foreign countries to identify possible prospects for the development of simplified proceedings on criminal cases at the pre-trial stage in Russian criminal procedure legislation. The object of the research is criminal procedure relations that arise during simplified investigations in foreign countries. The subject of the research is the norms of foreign criminal procedure legislation governing the procedure and grounds for proceedings on criminal cases in a simplified manner at the pre-trial stage. The purpose of the research is to develop proposals for improving Russian criminal procedure legislation in terms of simplified pre-trial proceedings on criminal cases. The methodological basis was the dialectical-materialistic method of cognition and general scientific and special research methods based on it (analysis, synthesis, logical-legal, comparative law). The basic method was a comparative analysis of the criminal procedure legislation of foreign countries regulating the simplified form of proceedings on criminal cases at the pre-trial stages. As a result of the conducted research, the author analyzed the features of legal regulation of simplified proceedings on criminal cases in foreign countries and carried out a comparative analysis of approaches to regulating the specified sphere of public relations based on which the author formulated proposals for the modernization of domestic criminal procedure legislation in terms of regulating simplified proceedings on criminal cases at the pre-trial stage of criminal proceedings.
