Ensuring the interests of the child in the framework of family law agreements’ notary certification

Abstract

The article discusses the existing gaps in the regulation of the notarial procedure for certifying family agreements, in terms of ensuring the interests of the child. Based on the most important imperative - the principle of legality - a notary, implementing the provisions of the law, certainly protects the rights and interests of a minor. However, the notary process of notarization of agreements concluded by family members does not provide for mandatory consideration of the opinions of the children themselves, which jeopardizes the observance and guarantee of the implementation of their best interests.
