Обеспечение интересов матери в семейных отношениях

Abstract

In the article, the author analyzes the norms aimed at ensuring the interests of the woman-mother as the most important subject ensuring the full functioning of the family, without whose participation the birth of children, and therefore the family’s performance of the reproductive function, is impossible. Family legislation provides for the establishment of the origin of children from the mother solely on the basis of the fact of the birth of the child, which confirms the priority of establishing the legal connection of the child with the mother, leaving the possibility of establishing the legal connection of the child with the father at the discretion of authorized entities. The article presents various norms of the Code of the Republic of Belarus on Marriage and Family, confirming the importance of the role of a woman-mother in family relationships and ensuring her interests. According to the author, legislation that provides for the possibility of changing a woman’s gender needs to be changed.
