Об особом статусе матери при решении вопроса об ограничении родительских прав

Abstract

The author draws attention to the manifestation of the specificity of the principle of equality of parents' rights when applying the restriction of parental rights by the court. Noting the open nature of the list of grounds for restricting parental rights provided by law, the author particularly focuses on the relationship between the civil and family law consequences of mental disorder of parents, gender reassignment by one of the parents. As a result of the study, the author comes to the conclusion about the special social role performed by the mother and the higher degree of responsibility of the mother when restricting parental rights not only hers, but also the child's father.
