Влияние частного и публичного интереса на формирование содержания соглашения об осуществлении семейных прав и/или исполнении семейных обязанностей

Abstract

The article is devoted to the issues of determining the limits of contractual freedom when forming the terms of an agreement on the exercise of family rights and/or the performance of family duties. The author concludes that the influence of public interest on the discretion of family relations subjects entering into agreements, both provided for by the legislation of the Russian Federation and not specified in it. The article defines the characteristic features of family relations and presents a position on the presence of family ties in an actual marriage and, as a result, on the conclusion by the actual spouses of agreements that regulate the exercise of family rights and/or the performance of family duties.
