Механизм осуществления контроля за исполнением концессионером концессионного соглашения: проблемы теории и практики

Abstract

In the article the relevance of the formation of mechanism of supervision over performance of concessionary agreement by concessionaire is substantiated. The author singles out four stages in the execution of concessionary agreements, each of which corresponds to the objectives that determine the forms and nature of control measures. The procedure and terms for exercising supervision over concessionaires should be included in the list of essential conditions of any concessionary agreement. It is proposed to unify mechanism of supervision in concessionary agreements in a single legal act, while allowing for the possibility of establishing special rules for certain areas.
