Interests in Russian constitutional law: a view through the prism of the 2020 amendments

Abstract

The object of the study is social relations arising in the process of constitutional-legal consolidation and protection of interests in the Russian Federation. The subject of the study is the evolution of the category of «interest» in the Constitution of Russia, its subject composition, forms of fixation and mechanisms of realization before and after the amendments of 2020. The purpose of the study is to identify and analyze changes in the constitutional regulation of interests, to identify new subjects-carriers and mechanisms for their protection. To achieve the goal the following tasks are solved: the study of the consolidation of individual and collective interests in the Constitution of Russia, the analysis of the subject composition, forms and methods of protection, the assessment of the consequences of the constitutional reform of 2020. The comparative-legal and system method form the methodological basis. As a result, it is established that the 2020 amendments expanded the scope of constitutional regulation of interests, introduced new categories of subjects and imposed additional responsibilities on the authorities. The author concludes that it is necessary to develop a doctrinal concept that provides a balance between private and public interests and criteria for their correlation in law enforcement.
