Violation of official discipline as a reason for dismissal from service in the customs authorities

Despite the clarity of the legal regulation of the procedure for the passage and termination of public service by citizens of the Russian Federation, in practice controversial situations arise when an official dismissed from service in the customs authorities disputes the conclusion on the results of an internal audit, an order for disciplinary responsibility and the imposition of disciplinary action, requires reinstatement in his former position, recovery of average earnings for the time of forced absenteeism, compensation for moral damage. The object of the study is the social relations that arise in the field of public service in customs authorities. The subject of the study is the legal norms governing the procedure for termination of public service in customs authorities. The purpose of this article is to consider the procedure for dismissal from service in the customs authorities in connection with a violation of official discipline. The study analyzed the materials of judicial practice, which indicate the use of an extreme measure of disciplinary responsibility – dismissal, which is inconsistent with the problems of the personnel of the customs service. The conclusion is formulated about the need for customs officials to be aware of the real situations leading to dismissal as a factor ensuring compliance with official discipline.
