On the plurality of fathers in parental legal relationships

This article addresses the issue of establishing a legal relationship between a child and a person claiming paternity. It examines the legal relationships that arise when a court decides to challenge the paternity of a man who is not the child's biological parent. The focus is on the concept of the “interests of the child” and their content when the court resolves a dispute between men, one of whom is the biological father of the child, and the other was registered as the father when registering the child’s birth and has actually been raising him from that moment on. The author appeals to the materials of judicial practice and the clarifications of the Plenum of the Supreme Court of the Russian Federation, identifying the criteria for ensuring the interests of the child when the court considers a dispute between men claiming to establish their paternity.
