Abstract

This article analyzes the challenges of law enforcement practice associated with the use of setoff as a basis for terminating obligations. Existing concepts of setoff over time are examined and their practical significance is determined using a specific example. In conclusion, the author proposes legislative changes that would help avoid the creation of an incorrect successor when using setoff.
