Criminal and legal characteristics of contraband of money and (or) money instruments: theoretical and practical aspects

Abstract

The article is devoted to the issues of legal regulation of the contraband of money and money instruments. It should be noted that the danger of such contraband has increased recently. The article presents a view on the need for special regulation of liability for the smuggling of money and monetary instruments. This should be related both to the proper legislative definition of the subject of the crime and to the correct classification of the relevant acts in practice. Achieving the goals of criminal proceedings is impossible without properly addressing the issue of compensation for damage caused by crimes. We believe that key aspects of compensation, such as the methods of compensation, the procedure, and the time limits, should be clearly defined at the legislative level. Research methods include formal logic, comparative analysis of legal categories, synthesis (generalization), complexity, and a systematic approach.
