Договорное регулирование семейных отношений в контексте укрепления духовно-нравственных ценностей и формирования ценностных ориентиров участников семейных отношений

Abstract

In the article, the author proposes to draw attention to the influence of legal regulation of contractual regulation of family relations on the formation of value benchmarks of each individual participant of family relations and society as a whole. The author cites the provisions of a number of policy documents, on the basis of which it proposes to rethink the contractual regulation of family relations in the context of the compatibility of the opportunities offered to the subjects of family relations with the objectives of strengthening spiritual and moral values, preserving traditional family values. In the legal regulation of family-law agreements, the author proposes to proceed from whether they are established as subjects of family relations during the period of functioning of the family or not, and the parties to family-law agreements defining rights and obligations of parents with respect to their minor children, determine on the basis of the need to ensure an increase in the authority of parenthood (parental authority) in society and in the individual family.
