Abstract

The object of the study is the relationships that arise in connection with the conclusion of fictitious marriages in the realities of their own. The subject of the study is the norms of family law governing the recognition of fictitious marriages as invalid and current judicial practice. The aim is to establish the specifics of proving the fictitiousness of marriage and the reasons for the prevalence of this phenomenon in modern realities. The specific tasks are: to study issues related to the conclusion of fictitious marriages; to substantiate the methods of protection used, including the annulment of a legal relationship. The results of the study can be represented by the following main conclusions. There has been a clear differentiation of judicial approaches to proving fictitiousness, depending on how much, in the opinion of the court, the public interest has been violated. Proving the fictitiousness of marriage is complicated by the lack of a legal definition of the concept of "family" and its features in family legislation.
