A conceptual analysis of grounds for termination of parental rights: from multiple grounds to a single criterion for failure to fulfill responsibilities

Abstract

This article analyzes the legal nature of the grounds for deprivation of parental rights enshrined in the Family Code of the Russian Federation. The author questions the traditional dogmatic approach, which assumes the autonomy of each ground, and substantiates the concept of a "single material basis." The study demonstrates that such offenses as malicious evasion of child support payments, child abuse, and chronic alcoholism are not independent legal facts, but rather various forms of culpable failure or improper performance of parental responsibilities.
