Positioning the digital avatar of personality in constitutional law (using the example of the «digital spouse»): reality and prospects

Abstract

This article examines the problem of positioning a person's digital avatar (using the example of a "digital spouse") from a constitutional and legal perspective. Using formal legal, sociological, and constitutional-hermeneutic methods, the author, based on an analysis of social practice and provisions of current Russian legislation, concludes that legalizing marital relations between humans and artificial intelligence is potentially unacceptable. The introduction of a digital "family friend" as a special legal object to strengthen the institution of family and marriage is promising, while not excluding the possibility of a different positioning, taking into account the specifics of social relations of a different nature.
