Abstract

This article examines conceptual approaches to regulating the criminal law institutions of probation and deferment of sentences, as they emerged in the legislation of CIS countries at the turn of the century. The aim of the study is to identify similarities and differences in national legislation regarding the legal nature of the non-application of actual punishment. To achieve this goal, the historical aspect of the formation of these institutions was studied and a comparative analysis of the trends in legal regulation in this area of public relations and the practice of law enforcement that developed in the post-Soviet period was conducted. Based on the conducted analysis, conclusions were drawn regarding the improvement of legal regulation of domestic institutions of probation and deferment of sentences.
