Abstract

The article explores the theoretical and practical issues of determining the legal nature of relations arising from a foster family agreement. It analyzes the existing doctrinal approaches to understanding this agreement as a civil or family law institution. Special attention is given to the issue of the independence of foster families as a form of care for children who have been left without parental care. The author examines the relevant provisions of the Family Code of the Russian Federation, court practice, and the scientific views of family law scholars. As a result, it is concluded that the relationship arising from the foster care agreement is complex and multifaceted, combining public law, family law, and civil law elements.
