Abstract

The Institute of Patent Law occupies a special place in civil law relations. In modern realities, the number of breakthroughs in industrial production and inventions in other spheres of life is rapidly increasing. In order for the inventor to be confident in the protection of his intellectual rights, the norms regulating the legal relations of patent rights, ways of their implementation and protection were introduced into the legislation. The author identifies the problems of the implementation of patent rights by a separate category of convicts serving a criminal sentence in the form of imprisonment, which do not allow the convicts to fully exercise their patent rights, and determines the optimal opportunities for their implementation.
