Abstract

The article considers some aspects of the meaning of the characteristics of the objective aspect of the crime for its qualification and the problems of their interpretation in law enforcement practice, proposals for improving the criminal law aimed at reforming Art. 238 of the Criminal Code in order to distinguish its three independent corpus delicti by introducing into the criminal law a separate provision criminalizing only the performance of works or services that do not meet the safety requirements of life or health of consumers.
