Abstract

The article analyzes the necessity and importance of studying foreign jurisdictions and the specifics of legal relations caused by foreign legal systems in the mechanism of ensuring the implementation of the constitutional right to judicial protection in the Russian Federation. As part of the analysis of the relevance of the issue, from the standpoint of constitutional ontology and methodology of law, it is stated that it is necessary to identify and study the features of accounting and application of the provisions of international treaties, regulatory procedural elements of legal systems of foreign countries and foreign judicial precedents in Russian judicial practice.
