Abstract

The article provides a historical overview of the transformation process of a criminal law provision relating to liberty restriction penalties. Different conceptual approaches of Russian and foreign researchers to the legal regulation of liberty restrictions and other noncustodial penalties have been investigated. The author discusses the difficulties appearing during the sentencing process regarding the restriction of liberty and makes a proposal for improving the criminal provisions.
