Abstract

The paper refers to the problem of fair implementation of criminal law norms that can be solved by scientifically based optimization of the penal system. The comparative analysis employed in the paper allows to reveal promising trends in foreign criminal legislation to take them into account and, with some amendments, to introduce into the Criminal Code of Russian Federation. It brings about improvement in present penal system by justifying the inclusion of a new type of punishment – «compulsory deportation out of Russian Federation».
