Abstract

The article considers the issue of the legality of the creation by the courts of the Russian Federation of new family rules if there are gaps in the leg-islation. The author, having studied the legislation of the Russian Federa-tion, the positions of the courts and the doctrine, came to the conclusion that the courts of the Russian Federation are not entitled to go beyond their powers and in the presence of gaps in the legislation, but to resolve the dispute in case of a gap in the law, apply the right of justice, family and universal values.
