Abstract

During the current period of development of the Russian criminal-legal doctrine, the problem of the legislator's use of potential opportunities to differentiate criminal responsibility for crimes against property is quite acute. One of the reasons for this situation is the lack of an appropriate system of measures in the criminal law aimed at establishing privileged criminal liability for individual attacks on property. The scientific debate on this issue has not only not exhausted itself, but also needs to be continued. This discourse proposes privileged signs of theft, justifies the view that the modified model of petty theft should be considered as a form of privileged corpus delicti, and developed legislative drafts of privileged crimes.
