Features of the subjective side of crimes against interests of service in commercial and other organizations: legal and technical analysis

The features of the signs of the subjective side of the crimes provided for in Chapter 23 of the Criminal Code of the Russian Federation are investigated. It is proposed that, according to the design example, «abuse of power» be deleted in Art. 201, 201¹, 202 of the Criminal Code an indication of special focus, including in the subjective side of abuse of authority motivation in the form of «selfish or other personal interest». It is shown that hidden selfish purpose is the inherent characteristic of the subjective side of the compositions of illegal receipt of the subject of commercial bribery (part 5 of article 204) and illegal receipt of the subject of small commercial bribery (part 1 of article 204²).Downloads
