Abstract

The article deals with the problem of judicial lawmaking in family matters by the example of the latest decisions of the highest court, the preconditions for this form of judicial discretion are revealed, legal positions on cases of challenging and establishing paternity, applying measures of responsibility for improper the upbringing of children, the recovery of alimony, parenting in surrogate motherhood.
