Abstract

The article concerns issues of correlation of such offenses as «theft» as a crime against property and «the theft of narcotic drugs or psychotropic substances and plants containing narcotic drugs or psychotropic substances or their parts containing narcotic drugs or psychotropic substances» as a crime against public security (hereinafter, «theft of drugs») in the modern criminal legislation of Russia. Is paid special attention to legal and technical analysis of the structural features of named attacks. Examines the question of the delimitation of the «theft of drugs» from the «theft of another's property» by criteria such as primary and secondary object, the subject of the offense, the time of the crime, the objective and the motive of the offense. Authors revision notes to section IX «Crimes against public security and public order» of the criminal code.
