Abstract

The proposed article is devoted to the study of theoretical and practical problems of the emergence and simultaneous action of legal relationships between the child's parents, his guardians (trustees) and the child himself. As a result of applying the methods of historical and comparative and system analysis, systematic and logical interpretation of family legislation and legislation on guardianship and trusteeship, the author comes to the conclusion that the legal relations are deliberately conflictious and suggests more precise regulation of the legal status of parents and guardians of minor children when establishing guardianship over them or guardianship.
