Abstract

The article deals with the problematic issues related to the application of the criminal law, which gives the court the right to change the category of the crime, including the positions of the resolution of the Plenum of the Supreme Court of the Russian Federation of may 15, 2018 № 10, specifically devoted to the of issues arising from the courts in the application of this rule of the criminal code of Russian Federation.
