Abstract

In the article the author substantiates a conclusion that the matrimonial contracts have an advanced (forward-looking) function as well as provides the analysis of this function. The existence of this functions in the matrimonial contracts is determined by the situational method intrinsic to family law and by the ability of these contracts to overcome the gaps in law. The realization of the advanced function in full extent is possible providing that these contracts are recognized by law-makers or subject to the positive acceptance of such practice by the judiciary.
