Abstract

Various points of view on the definition of certain categories of special subjects as officials are given here. Questions of public danger of power abuse in commercial and other organizations in comparison with abuse of official powers are considered. Problems of these crimes definition in connection with expanding the concept of official are analyzed. Attention is focused on issues related to the possible improvement or deterioration of the situation of persons brought to criminal responsibility. Unification of the punishments’ sizes and types established for committing the crimes provided by articles 201 and 285 of Russian criminal code is offered.
