Abstract

In article questions of encumbrance by easements and public easements of the land plots are considered. The comparative analysis of the easements established on the land plots which are in a private ownership, the easements established on the land plots which are in a municipal and state property and public easements is carried out. In the conditions of the market relations the importance of legal regulation of the land relations sharply increases. The land plot as an object of an ownership right and other property relations is unique. Still there is no uniformity in understanding of a land easement that, undoubtedly, is a reason for numerous scientific discussions. The history of development of easements is a history of development of a private ownership on the earth. The relevance of a case in point is obvious to practice.
