Abstract

The article considers issues of forming of methods of estimation of the latency of the penitentiary crime. Is the scientific study of the detection latency of the penitentiary crime due to specific procedures and evaluation activities. Methodological basis of research is the set of techniques and ways of knowing are given, including comparative legal, logical-legal analysis of documents, statistical materials. It is proposed to carry out the analysis of documents reflecting the activities of correctional institutions, as well as anonymous or open evidence of persons who know information about the crimes, the information obtained will allow to identify the facts of the latency of the penitentiary crime. The efficiency of detecting latent crimes through the study of documents is ensured primarily by means of prosecutorial supervision. It is noted that the technique of detecting latent crime in places of deprivation of liberty depends on the mechanism of Latinization prison crime that dictate the need for extensive use of so-called indirect methods of detecting latent crimes. The identified level of latency of the penitentiary crime should be recorded as: a) the base of the selection and application of specially-criminological prevention in the activities of the institutions and bodies of the FSIN of Russia, which is primarily of routine nature; b) one of the criteria for assessing the performance of corrections. Today the latency as a criterion is not used, giving place to the only registered crime. This circumstance does not allow to objectively assess the effectiveness of specific correctional institutions; C) the correction factor in the projections of the crime of convicted persons in places of deprivation of liberty.
