Abstract

In article categories the qualifying signs and circumstances aggravating punishments are analyzed. Their general and distinctive features come to light. Their ratio with concepts an individualization and differentiation of criminal liability is considered. The conclusion about distinction of the legal nature of the aggravating circumstances and the qualifying signs, and need of legislative fixing of the last is drawn.
