Abstract

The article is devoted to the issue of the legal nature of remuneration for guardians and trustees, paid under the agreement on the exercise of guardianship and trusteeship. It is emphasized that relations related to the grounds and procedure for payment of remuneration are governed primarily by regional legislation. The article analyzes examples from the judicial practice in which this issue is addressed. The conclusion is substantiated that the remuneration in contractual care should be regarded as an independent type of payments for trustees (trustees). In addition, the main scientific points of view on the problem of the legal nature of treaties in the field of guardianship and guardianship are examined. It is noted that the problem of determining the legal nature of remuneration of trustees (trustees) is closely related to the question of the legal nature of contracts, under which trustees (trustees) receive appropriate payments.
