АДМИНИСТРАТИВНОЕ ПРИНУЖДЕНИЕ В ОБЛАСТИ ОБЕСПЕЧЕНИЯ АВИАЦИОННОЙ БЕЗОПАСНОСТИ

Abstract

Introduction: The mechanism used to ensure aviation security is based on state coercive measures’ application. The research goal was an attempt to determine the essential features, characteristics and gaps that could exist in legal regulation and application of specific administrative coercion measures in air transport field. The methodological basis is a set of general scientific and particular scientific (logical-legal, comparative-legal) knowledge methods. Results are as follows. The author has found out contradictions of the legal norms governing the application of various types of inspections for air transport established by the Air Code of the Russian Federation and the Federal Law "On Transport Security". Conclusions say that administrative coercion in aviation security field shall be considered as application by authorized federal executive authorities of administrative measures in the procedural forms established by administrative law rules, which entails some legal effects for air transport infrastructure entities, operators, aviation personnel, passengers, individuals located as well as other persons operating on the territory of air transport infrastructure.
